TERMS AND CONDITIONS OF HIRE
- Hire Duration: The hire period commences from the date of goods delivery and concludes upon notification of completion, cancellation, by the hirer or their representative or upon equipment return to CarePlus Living Solutions.
- Extension of Rental Period: A hire period may be extended, subject to the same terms and conditions as outlined herein. CarePlus Living Solutions retains the discretion to decline an extension of the hire period.
- Payments: Rental payments will revert to automatic weekly charges to the provided credit card and will continue until CarePlus Living Solutions notified of the end of hire by the hirer or their representative and equipment received by CarePlus Living Solutions.
- Equipment Maintenance: All equipment repairs during the rental period must be carried out exclusively by CarePlus Living Solutions staff.
- Care and Accountability: The Hirer is responsible for the proper care and maintenance of the equipment, recognizing reasonable wear and tear.
- Equipment Inspection upon Return: (a) The rented equipment is provided free from defects and in good condition. (b) Equipment will undergo inspection upon return. (c) The Hirer is liable for the cost of rectifying any damage to the equipment beyond ‘normal wear and tear’ during use. The cost of rectification will be either the repair cost or the replacement cost of the equipment, at the discretion of CarePlus Living Solutions, regardless of the equipment’s age at the time of damage. CarePlus Living Solutions reserves the right to recover these costs from the Hirer. (d) Any charges by CarePlus Living Solutions will be payable by the Hirer upon receipt of a valid tax invoice.
- Security Deposits: (a) If a deposit has been collected, CarePlus Living Solutions reserves the right to retain the deposit to offset the cost of any equipment rectification or replacement, at its discretion. (b) If applicable, a minimum of two weeks’ rent in advance is held as the deposit.
- Refunds: Any refunds will be processed exclusively via Electronic Funds Transfer (EFT) to an account or credit card.
- Ownership: The Hirer shall not sell, transfer, assign, mortgage, pledge, sub-let, lend, or otherwise deal with the Equipment without prior written consent from CarePlus Living Solutions.
- Lost or Stolen Equipment: In the event of lost or stolen hired equipment, CarePlus Living Solutions will charge the Hirer the replacement value of the equipment or the nearest equivalent. The replacement value shall be reasonably determined by CarePlus Living Solutions.
- Indemnification: The Hirer shall indemnify CarePlus Living Solutions against any loss or damage arising in connection with the equipment or its use by the Hirer or any other person while the equipment is under the Hirer’s responsibility.
- CarePlus Living Solutions Warranty: The Hirer is entitled to the conditions, warranties, and other rights implied by law, which cannot be excluded by agreement. This agreement does not limit the benefits of those conditions, warranties, and rights in any way.
- Hirer’s Authorization: The Hirer warrants that they are authorized to enter into this agreement on behalf of all individuals who possess, use, or operate the Equipment until the Equipment is returned.
- Purchase of Hired Items: Items may be available for purchase. If a purchase request is made for a hired item and CarePlus Living Solutions approves the sale, the purchase price will be determined as the greater of: (a) The Recommended Retail Price (RRP) minus 50% of the total paid in rental fees. (b) 50% of the RRP of the item.
